By accessing our website, making a reservation, or participating in our vacations, you agree to these Terms & Conditions intended to ensure a safe, enjoyable, and legally compliant experience for all our guests.

1. General Terms

Barevaya offers vacations experiences for adult men. When you register, check in, or use our services, you confirm that:

• You are at least 20 years of age and legally able to enter into these terms.
• You accept responsibility for your conduct and any outcomes resulting from your participation in our events.
• Barevaya reserves the right to refuse service or admission at its sole discretion and may ask a guest to leave without refund for non-compliance with these terms.

2. Booking & Reservations

• Bookings: Reservations are made via our website and are considered tentative until full payment is received. Reservations are processed on a first-come, first-served basis following a virtual consultation.
• Late Bookings: Subject to availability and require immediate full payment. Bookings made less than 10 days prior to the date of arrival cannot be guaranteed.
• Security Deposit: A security deposit is required within one week prior to arrival to cover damages or any outstanding charges. Reservations may be canceled if the security deposit is not received prior to arrival.
• Guest Responsibility: Guests are responsible for any damages they cause.

3. Reservations & Cancellation Policy

Our flexible reservation policy is as follows:

Reserve Now, Pay Later: No payment is required at the time of booking; however, your reservation is not confirmed until full payment is received.

Transfer Reservation to a Friend: If you make a reservation but you are no longer able to participate, you may transfer it to another individual of your choosing. Your replacement will also need to complete and online reservation before the transfer is confirmed. 

Limited Availability: Reservations are confirmed only once payment is received. Availability is subject to change, with priority given to guests who complete payment by the deadline.

Cancellation Terms:

• 100% Refund (3 months before arrival): You may cancel your reservation without any penalties or fees up to three months before your arrival.
• 50% Refund or 100% Credit (2 months before arrival): If you cancel your reservation between after between the 3rd and 2nd month before your arrival, you will receive a 50% refund or a 100% Barevaya credit (valid for 12 months).
• 50% Credit (1 month before arrival): Receive a 50% Barevaya credit (valid for 12 months), if you cancel your reservation between the 2nd and 1st month before your arrival.
• No Refund or Credit (less then 1 month before arrival): Cancellations made less than 1 month before arrival are not eligible for refund or a Barevaya credit.

4. Nudity & Code of Conduct

• Nudity is allowed only in designated areas, such as the pool and outdoor lounge areas.
• Nudity is not permitted in dining areas or indoor common spaces outside designated locations.
• All guests are expected to adhere to local regulations and community standards of decency. Offensive, aggressive, or disruptive behavior may result in removal without refund.
• Harassment or any form of inappropriate behavior will not be tolerated and may lead to exclusion from future events.

5. Limitation of Liability & General Release / Indemnification

Your use of Barevaya services, participation in events and activities, or use of facilities is at your own risk. This includes, but is not limited to:

• Personal injury, illness, or accidents
• Loss or damage to personal belongings
• Natural hazards, environmental factors, or other force majeure events

BAREVAYA DISCLAIMS ALL LIABILITY FOR DAMAGES, LOSSES, OR INJURIES, INCLUDING THOSE ARISING FROM NEGLIGENCE.

To the fullest extent permitted by law, you agree to:

• Assume full responsibility for any risks, injuries, or damages incurred during your stay.
• Release, indemnify, and hold harmless Barevaya, its owners, employees, agents, and affiliates from any claims or liabilities arising from your participation, including those resulting from the actions of third-party agents or your own actions.
• Waive any rights to pursue legal claims against Barevaya for damages or losses.

6. Event Changes & Cancellation

Barevaya reserves the right to modify event details—including activities and schedules—as needed. In the event of extraordinary circumstances, an event may be canceled.

• If an event is canceled, advance payments will be refunded; however, Barevaya is not responsible for any additional expenses, such as travel or accommodation costs.

7. Promotional Restrictions

• Guests are not permitted to distribute promotional materials or solicit business for external organizations without prior authorization.
• Violations may result in immediate removal without refund and could lead to legal action.

8. Website Terms & Conditions

• Content Use: The Site’s content is provided for informational purposes only. Downloading, copying, or distributing any content implies acceptance of these terms.
• Disclaimers: The Site is provided “as is” without any warranties. Barevaya is not responsible for errors, omissions, or inaccuracies.
• Liability Limitations: Barevaya is not liable for any damages resulting from your use of the Site, technical issues, or third-party links.
• Usage Restrictions: The Site may not be used for illegal activities, including copyright infringement, hacking, or the distribution of harmful software.
• Intellectual Property: All content, trademarks, and materials on the Site are the property of Barevaya. Unauthorized use is prohibited.

9. Unforeseeable Circumstances 

Barevaya is not responsible for service disruptions beyond our control, including but not limited to:

• Power or water outages
• Natural events (e.g., earthquakes, floods, wildfires)
• Government restrictions or travel bans

No refunds or reimbursements will be provided for reservations and activities affected by force majeure circumstances.

10. Additional Fees

• Reservation Changes: Modifications to your reservation will incur a non-refundable fee of $50 per change.
• Late Check-Out:
  • Approved Late Check-Out: $20 per hour
  • Unapproved Late Check-Out: $30 per hour
    (Check-out time is 11:00 AM.)

11. Prohibited Items

For the safety of all guests, the following items are strictly prohibited on the premises:

• Pets (except for approved service animals)
• Fireworks, firearms, or explosives
• Illegal substances

Violations may result in immediate removal without refund and potential legal action.

12. Photo & Media Release & Guest Photography Policy

• Barevaya will only capture photographs and record videos of guests for promotional purposes with the guest’s explicit prior written consent.
• If you do not wish to be included in promotional materials, please notify us in writing before or upon your arrival.
• Guests are prohibited from photographing or recording other individuals without each person’s explicit consent.
• Any unauthorized capture, distribution, or publication of images or videos of others may result in removal from the premises without refund and possible legal action.

User-Generated Content & Photo Release Clause

Content Ownership & Usage Rights

✅ By attending a Barevaya retreat, you grant Barevaya LLC a non-exclusive, royalty-free, worldwide license to use guest-generated content (photos, videos, testimonials) for marketing.
✅ This includes social media, website features, and promotional materials.

Opt-Out Option for Guests

• Guests who do not wish to appear in photos/videos can request exclusion by emailing [insert email] before the retreat.
• Barevaya will make reasonable efforts to respect privacy requests but cannot guarantee full exclusion from background footage.

Testimonials & Reviews

• If a guest leaves a review or testimonial, Barevaya has the right to feature it on its website & promotional materials.
• Reviews may be edited for clarity but will not be misrepresented.

13. Trademark Notice

• The name “Barevaya” and all associated logos, trademarks, and intellectual property are protected under international law.
• Unauthorized use or reproduction is strictly prohibited and may result in legal action.

14. Email Collection & Communication

By using Barevaya.com, you acknowledge and agree that:

• • Email Collection: Barevaya.com has the right to collect and store email addresses of users who:
    • Register, inquire, or book a retreat.
    • Subscribe to newsletters or promotional content.
    • Participate in surveys, giveaways, or contests.
    • Engage with the website for customer support, inquiries, or services.
  • Use of Emails: Barevaya.com may send emails to users, including:
    • Booking confirmations, itinerary updates, and customer support responses.
    • Promotional offers, updates on retreats, and exclusive content.
    • Surveys or feedback requests to enhance user experience.
  • No Third-Party Sales: Under no circumstances will Barevaya.com sell, rent, or share email addresses with third-party companies, marketing agencies, or external organizations. All communications are solely for Barevaya-related purposes.
  • Opt-Out Option: Users may unsubscribe at any time from promotional emails by clicking the “Unsubscribe” link in any email. However, essential booking-related emails will still be sent.

17. Travel & Liability Disclaimer (Assumption of Risk Clause)

17.1 General Disclaimer

By booking a retreat with Barevaya, you acknowledge that travel involves inherent risks, including but not limited to:
✅ Weather disruptions or natural disasters.
✅ Illness, injury, or accidents during travel or activities. We strongly recommend Travel Insurance option.
✅ Unexpected transportation cancellations or delays.
✅ Third-party vendor failures (hotels, yacht companies, drivers).

Barevaya assumes no liability for personal injury, property loss, or trip disruptions beyond its direct control.

17.2 Assumption of Risk

• Guests participate voluntarily in all activities and accept full responsibility for personal safety.
• Guests confirm they are physically fit to participate in travel activities.

17.3 Force Majeure Clause

Barevaya is not responsible for cancellations or disruptions due to unforeseeable events (e.g., wars, pandemics, government restrictions).

📌 Important: Guests are strongly encouraged to purchase travel insurance to cover unexpected cancellations.

18. Payment & Chargeback Protection Policy (Refunds & Fraud Prevention)

18.1 Payment Terms

• All retreat bookings must be paid in full or through an approved payment plan.
• Payments are securely processed via Stripe.

18.2 Refund & Cancellation Policy

✅ 100% refund if cancellation is made within 48 hours of booking (only if the retreat is more than 90 days away).
✅ 50% refund if canceled at least 60 days before the retreat start date.
❌ No refunds for cancellations within 30 days of the retreat.

18.3 Chargeback & Fraud Prevention Policy

• By booking, you agree not to file a chargeback for non-refundable transactions.
• If a chargeback is filed against the cancellation policy, Barevaya reserves the right to dispute the claim and take legal action.
• Guests must agree to the refund & chargeback policy at checkout by checking a box.

19. Final Acknowledgement

Use of the Barevaya website, reservations, or participation in our vacations constitutes your agreement to these Terms & Conditions.
